In these two cases, employees cannot refuse to transfer their posts. If they refuse, they may be regarded as serious disciplinary violations. Article 40 of the Labor Contract Law stipulates that in any of the following circumstances, the employer may terminate the labor contract after notifying the worker himself in writing 30 days in advance or after paying the worker an additional month's wages:
1. The laborer is unable to engage in his original work or other work arranged by the employer after the prescribed medical treatment period expires due to illness or non work related injury;
2. The laborer is incompetent for his work and still is incompetent after training or job adjustment; It should be noted here that although in the above two cases, workers should be subject to job transfer. If the workers do not obey, the unit should have corresponding rules and regulations to deal with their refusal to transfer.
Other job transfer behaviors belong to the scope of changing the labor contract, and employees have the right to refuse. The labor contract signed by an employee when he or she enters the company generally has a position agreement, and post adjustment is strictly a change of the labor contract. Since it is a change of the labor contract, the Labor Contract Law stipulates that this requires both parties to reach consensus. If there is no consensus, the unit cannot forcibly transfer the position. If the post is forcibly transferred, the laborer has the right to refuse to perform his duties in the new post. However, it should be noted here that if you do not agree to perform your duties in a new position, you should stick to the original position and never be absent from work. Once you are absent from work, the company will deal with it according to relevant regulations, such as dismissing you directly after a certain number of days of absenteeism. Some friends may think that in addition to the two types of job transfer mentioned above, there are other situations that can be unilaterally transferred. I don't agree with this view. The so-called job transfer is either a legal job transfer or a change in the content of the labor contract, and there is no other situation. As for the job transfer, I hope the employer will not be too headstrong. If it fails, labor disputes may arise, which will be passive.
How to refuse the four taboos of internal job transfer?
1: "Anti customer oriented"
In the attitude of admitting mistakes, ask the boss if he has done badly or wrongly in his original position, and ask the boss to seriously point out that he will make good corrections!
Can't a discerning person see that you are nostalgic for your original position?
2: "Play hard to get"
First, I told my boss that I would study hard, work hard and enter a new role as soon as possible if I went to a new position! However, he also told his boss that he was familiar with the original job and might make greater achievements. Then he listed the unsuitability between himself and the new position. The more, the better!
As long as the boss is reasonable, you should be able to see that you don't like your new position very much.
3: "Think what others think"
Use sufficient evidence to prove that the original workers in the new position are better than themselves, so that the boss thinks that the original workers in this position are more competent, and changing people is not the best decision, so you can still stay in the original position!
4: "Let it be"
If all the moves are exhausted and the boss still wants to transfer you to a new position with various reasons and excuses, then you should go with it! As the old saying goes, where can't there be a scholar!
It is really not advisable to refuse the management requirements of the leader outright. Although the consequences may be large or small, the impact is very bad. Therefore, it is not recommended that you easily reject the leader's opinion without knowing the situation.
Reject the company's job transfer Don't do that
1. To understand the old employees of the company
Old employees are older employees in the company. They have experienced many things in the company. They have far more recognition or understanding of the company than you, and know more about the operation of the new organization for you.
In addition, some of the old employees of the company are old timers, and they have no passion for their work. Their views on the company and work style are completely different from those of your new employees.
So when you enter a new company, you must learn to understand this group first, and then avoid conflicts with it on some matters. Some are listed below.
2. Avoid excessive self-expression in the group
Many people want to show themselves, most of which are in the hope of being recognized by others. Especially new employees will frequently show their "muscles" to show their ability.
For example, some newcomers' trade unions are very willing to have a good relationship with their leaders and listen to their leaders' arrangements. At this time, many newcomers also have the illusion of being led by new people and will despise the old employees of the company, which is very difficult for these old employees to accept and be vigilant.
In the process of management, leaders say that they have the right to make decisions and speak, but there are differences in the distance. If you intervene too much, old employees will feel that their position and territory have been violated and threatened.
Therefore, we must not excessively show our ability and report to the leaders. This will be suspected of breaking the workplace order and rules, and we cannot show ourselves by suppressing and belittling others.
The company is a group, which needs to be integrated rather than independent. Overexpression of yourself will make you out of the group and will not be welcomed by the group.
3. Never habitually shirk responsibility
New employees have no sense of security when they are new to the workplace. If they encounter difficult problems or have some small problems, they like to take themselves out, which is simply to say, to shirk responsibility. I'm always afraid of making mistakes and affecting my position and development in the company.
So when encountering problems, I always like to say that this is not my decision, but who asked me to do that.
In some cases, it may not really be your fault, saying that you are carrying the blame for others, but you should understand that there is no fool in the workplace, whose fault may be uncertain for a while, but everyone will understand later.
However, it is customary to push out the responsibility first, which may avoid being criticized and criticized by leaders in a short time. But in the long run, no one likes such people, especially the veteran labor union.
The reason is very simple. You need to join a group. As a newcomer, you lack group trust. At this time, you pick yourself up completely. If your right and wrong are more important than the team, then you will naturally be excluded by the team.
4. If you don't know your role orientation, you will suffer a lot
Everyone in the team has his or her own role orientation, and should clearly know his or her own orientation. Do not use his or her previous role or orientation to perform in a new group.
For example, if you were a student before, no one will treat you as a student in the new group. The leader of the group was mentioned before, but you may not play such a role in the new group. You should quickly find your own position and role.
To be understandable, everyone is a versatile person. He or she talks about a good son and father at home, a good boyfriend in front of his or her girlfriend, and a good brother in front of his or her friends. Is he a good employee or a good leader in the workplace, in front of the boss? Be sure to show a good subordinate.
For example, report up and down in a timely manner, arrange dinner parties and unite team members, and understand the exchange of interests, mutual trust and assistance. These roles must be clear and understood first. Don't rely on others' reminders. Nor can it be regarded as enjoying the help of others with peace of mind.
5. People with low EQ are terrible
As we all know, there are many expressions of emotional intelligence. In fact, the simple summary is that emotional intelligence is: you should be able to judge the situation, understand others, use some social or communication skills to control our own thinking and help us make the right decisions.
For example, walking with the leader, walking in front of the leader, and speaking ill of the direct leader in front of the boss are all basic EQ problems.
Even sometimes, you may offend others without doing anything, so people can't do it in the workplace, and they will teach you slowly, but you can't do it. It is a truth to be a man before doing anything.
There are many rules in the society, and the same is true in the workplace. Most of the time, you pay a lot of energy and time, not to make people treat you well or help you, but to try not to offend people and let you help you.
So if you are new to the workplace or a company, you must treat your colleagues and yourself carefully.
If you have offended your colleagues and leaders carelessly, don't be afraid. After all, there is still a long way to go. In the later stage, you should behave with a correct attitude, work seriously, boast more when meeting people, do more when encountering problems, communicate more with people, learn more about the company's information, and establish good interpersonal relationships in order to better help you go forward.
